Minors eloping not an offence?

on Oct 21, 2013 , 11:36 am
Just read this news about High Court's ruling that says 'minors eloping to marry is no offence'. I don't understand on what grounds can court pass such a ruling.

Apparently, Punjab and Haryana high court has ruled out this message to bring down honour killings and has even asked the police to give protection to couples who have got married against the wish of their parents.

I think such a ruling would only promote child marriage and more minors would get marry before the desired age leading to several issues. Do you think it makes any sense?

it seems 18 is too high an age in Indian context, there ought to be some flexibility to accommodate rural/tribal customs so that it could be lowered but not below a certain age. court decisions must be read in the social context to resolve the problems, these do not follow the niceties of legality.

As usual to stop one social evil, a thousand new ones come crawling out of Pandora's box. Let's face it social attitudes have to change before judicial laws need to be amended.

The court has created more confusion and given a contradictory judgement. The Legal Age as per Prohibition of Child Marriage Act, 2006 is 18 for girls and 21 for boys. Marrying below the legal age is an offense. Then how can the court pass such judgement? Marriage is not a joke. A person should be mature and experienced enough before getting married. A girl does not have enough maturity and experience to tie the knot before 18. Marriage is a lifelong commitment, and every individual should give due thought before rushing into it.

minors should be in a school or college ,if they value education via their parents ,they will never find an escape route like eloping..it will not be the fear of parents but love for the parents ,that will stop them from taking a drastic step that will bring shame to the family and endanger the lives of teenagers ...it is not only the teenagers want to get away from the parents by eloping ,even some parents want to get rid of their daughters ,then blaming them later for bringing dishonor to the family.

This is ridiculous thing to say that eloping is not an offence. Minors are immature and don't really understand what is right and what is wrong.
